Florida Child Pornography Charges: What’s at Stake

The charging structure under Florida Statute 827.071 creates exposure that grows rapidly with the number of files involved. Possession of child pornography is a third-degree felony, carrying up to five years in state prison and a $5,000 fine. Florida law authorizes a separate criminal count for every image or file found, and a sentencing judge can order those sentences to run consecutively.

How Charges Escalate

Charges escalate based on conduct and quantity. Possessing three or more copies of the same image is treated as prima facie evidence of intent to promote, which elevates the offense to a second-degree felony punishable by up to 15 years. Sharing or transmitting material to another person also qualifies as a second-degree felony. Production or promotion of a sexual performance by a child is a first-degree felony, carrying up to 30 years in state prison.

Florida Statute 775.0847 adds an additional layer of enhancement. When aggravating factors apply, such as possessing 10 or more qualifying images, a third-degree charge can be reclassified to second-degree, and a second-degree charge elevated to first-degree. The cumulative sentencing exposure across multiple counts isn’t theoretical. A conviction on even a moderate number of counts can result in decades of imprisonment before any enhancement applies.
