Florida Child Pornography Charges: What’s at Stake

The charging structure under Florida Statute 827.071 creates exposure that grows rapidly with the number of files involved. Possession of child pornography is a third-degree felony, carrying up to five years in state prison and a $5,000 fine. Florida law authorizes a separate criminal count for every image or file found, and a sentencing judge can order those sentences to run consecutively.

How Charges Escalate

Charges escalate based on conduct and quantity. Possessing three or more copies of the same image is treated as prima facie evidence of intent to promote, which elevates the offense to a second-degree felony punishable by up to 15 years. Sharing or transmitting material to another person also qualifies as a second-degree felony. Production or promotion of a sexual performance by a child is a first-degree felony, carrying up to 30 years in state prison.

Florida Statute 775.0847 adds an additional layer of enhancement. When aggravating factors apply, such as possessing 10 or more qualifying images, a third-degree charge can be reclassified to second-degree, and a second-degree charge elevated to first-degree. The cumulative sentencing exposure across multiple counts isn’t theoretical. A conviction on even a moderate number of counts can result in decades of imprisonment before any enhancement applies.

Federal Sentencing & Sex Offender Registration

Federal sentencing is severe. Under 18 U.S.C. § 2252, a first-time distribution offense generally carries a statutory minimum of five years and up to 20 years in federal prison. Simple possession for a first offense can result in up to 10 years. Beyond incarceration, a conviction at either level requires registration as a sex offender. Depending on the severity of the offense, registration periods can range from 15 years to 25 years or a lifetime, carrying restrictions on residency, employment, and daily movement that can follow a person long after release.

Defense Strategies in Child Pornography Cases

Every defense begins with the evidence. Because the state’s case in these matters is built almost entirely on digital forensic evidence, the integrity of that evidence and how it was obtained matters enormously.

Several defense approaches may apply depending on the facts:

Lack of knowledge or intent: A defense may establish that the accused didn’t intentionally view, download, or possess the material in question.
Third-party device access: Other people may have had access to the same phone, computer, or network. That shared access can raise genuine questions about who actually possessed or viewed the material.
Unlawful search and seizure: Evidence gathered in violation of the Fourth Amendment may be inadmissible. Suppression of key digital evidence can significantly weaken the prosecution’s case.
Age of the person depicted: If the individual depicted was 18 or older, charges tied to that specific material may not hold.
Entrapment: When law enforcement induced conduct the accused wouldn’t otherwise have engaged in, entrapment may be raised as a defense.
