Florida Homicide Charges: What the Law Actually Says

Florida law divides homicide into distinct charge categories, each carrying different elements the prosecution must prove and different sentencing consequences. The charge determines the potential penalties and shapes the defense strategy. Understanding the difference matters from day one.

First Degree Murder

First degree murder is a capital felony in Florida. It requires proof of premeditation: that the defendant planned or consciously decided to kill before acting. It can also be charged under the felony murder rule, where a death occurs during the commission of certain enumerated felonies regardless of intent. Those offenses include arson, sexual battery, robbery, burglary, kidnapping, aggravated child abuse, carjacking, home-invasion robbery, and trafficking offenses, among others. A conviction carries the death penalty or life in prison without the possibility of parole.

Second Degree Murder

Second degree murder doesn’t require premeditation. The prosecution must prove the killing resulted from a depraved mind showing no regard for human life. It is a first degree felony, punishable by up to 30 years in prison and fines up to $10,000.

Manslaughter & Related Charges

Manslaughter in Florida is the unlawful killing of a person without malice, generally charged as a second degree felony and carrying penalties of up to 15 years in prison. DUI manslaughter and vehicular homicide are separate categories that apply when a death results from impaired or reckless driving, each with its own sentencing structure.

In every homicide prosecution, the burden of proof rests entirely with the state. The prosecution must prove guilt beyond a reasonable doubt. The defense doesn’t have to prove innocence.

Common Defenses in Florida Homicide Cases

Self-Defense & Stand Your Ground
Florida’s Stand Your Ground law allows a person to use force, including deadly force, when they reasonably believe it is necessary to prevent death or great bodily harm. Critically, it removes the duty to retreat before using that force, provided the person isn’t engaged in criminal activity and is in a place where they have a right to be. When Stand Your Ground applies, an attorney can file a motion to dismiss before trial. Mistaken Identity
