What are the Grounds for Divorce in Florida?

Dissolution of a marriage is the legal act of terminating a marriage through a court action.   Florida statutes were designed to encourage amicable settlements so as to make it easier to dissolve a marriage thereby reducing potential harm to children and spouses during the divorce procedure.  Because Florida's divorce system is based on the principle of "no-fault," meaning that a divorce will be granted if either party believes that the marriage is over, you do not have to have a specific reason for wanting to get divorced.  Generally, the causes of the failure of the marriage are not an issue in court although it does need to be shown that the marriage is irretrievably broken.  This basically means that the spouses have differences that cannot be settled.  Although rare, if there are minor children, or if a claim of irretrievable breakdown is denied, the court can at its discretion order counseling and continue the proceedings for three months.

The only other ground for divorce that would affect this is if one of the spouses is deemed mentally incapacitated in some way, in which case that party needs to be adjudged as incapacitated according to the provisions of Florida statutes.  The ground for the dissolution based on the incompetence of one of the parties is rarely used.
